1. Description of Service

BrutalRoast is an AI-powered startup audit tool that analyzes your startup's positioning, ideal customer profile (ICP), pricing strategy, and market differentiation. The Service generates scored feedback reports based on information you voluntarily provide.

All audit results are generated by artificial intelligence and are provided for informational purposes only. They do not constitute business, legal, financial, accounting, or investment advice. You should not act solely on the basis of AI-generated output without independent professional judgement.

We make no representation that the Service is suitable for your specific business situation or will produce accurate results for your use case.

2. Eligibility & Account Registration

You must be at least 18 years of age to use the Service. By creating an account, you represent and warrant that:

• You are at least 18 years old;
• You have the legal capacity and authority to agree to these Terms;
• The information you provide during registration is accurate and current;
• You will keep your account credentials secure and not share them with any third party.

You are responsible for all activities that occur under your account. If you suspect unauthorized access to your account, notify us immediately at rajkateshiya.rk12@gmail.com.

3. Free Tier & Subscription Plans

The Service is offered in the following plans:

• Free Plan: Each registered account receives one (1) complimentary audit at no charge. The free audit is provided as-is, with no guarantee of availability.
• Pro Plan: A one-time payment grants unlimited audit access. The current price is displayed on the Pricing page at the time of purchase. We reserve the right to change pricing for new customers at any time without prior notice. Existing Pro customers are not affected by price changes after their purchase. All Pro plan purchases are non-refundable — see Section 4.

We reserve the right to modify, limit, or discontinue the Free Plan at any time with reasonable notice.

4. Payments & No-Refund Policy

All payments are processed by Dodo Payments, our third-party payment processor. By making a purchase, you also agree to Dodo Payments' terms of service and privacy policy.

All sales are final. We do not offer refunds, credits, or exchanges under any circumstances. By completing a purchase, you acknowledge that you have read and understood what the Service provides, and you expressly agree to waive any right to a refund. The digital nature of the Service — instant delivery of AI-generated audit results — means the Service is consumed at the moment of generation, and no reversal is possible.

You are strongly encouraged to use the free tier to evaluate the Service before purchasing Pro access. The existence of a free audit is provided specifically so you can assess the quality and suitability of the Service prior to any payment.

All prices are listed in US Dollars (USD). You are responsible for any applicable taxes, duties, or currency conversion fees imposed by your bank, card issuer, or jurisdiction.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Submit any content that is illegal, defamatory, hateful, obscene, or that infringes any third-party intellectual property rights;
• Submit confidential or proprietary information belonging to another person or entity without their explicit authorization;
• Attempt to reverse-engineer, decompile, or extract the AI prompts, model outputs, or any proprietary logic of the Service;
• Use automated scripts, bots, or scrapers to access the Service beyond the rate limits permitted by your plan;
• Attempt to circumvent rate limits, authentication, or any access controls;
• Use the Service to compete with or replicate BrutalRoast by reselling outputs or building a competing product based on our system;
• Interfere with or disrupt the integrity or performance of the Service or its infrastructure.

We reserve the right to suspend or terminate your account immediately for any violation of this section.

6. User Content & Data

You retain ownership of all startup information and content you submit to the Service ("User Content"). By submitting User Content, you grant us a limited, non-exclusive, worldwide, royalty-free licence to process, store, and transmit your User Content solely for the purpose of providing the Service to you.

You represent and warrant that:

• You own or have the necessary rights to submit the User Content;
• The User Content does not violate the rights of any third party or any applicable law.

We do not use your User Content to train AI models. Your audit inputs are sent to our AI provider's API solely to generate your result and are not retained by us beyond what is necessary to deliver the Service.

7. Public Share Feature

The Service includes an optional feature to generate a public shareable link for your audit result. By using this feature, you acknowledge that anyone with the link will be able to view the audit content, including your startup description and scores, without authentication. You use this feature voluntarily and at your own discretion. You may remove the public share link at any time by deleting the audit from your dashboard.

8. Intellectual Property

The Service, including its design, software, branding, prompts, scoring methodology, and all content created by us, is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works of any part of the Service without our prior written consent.

The AI-generated audit report delivered to you is provided for your personal or internal business use. You may share it publicly (e.g., via the Share feature or on social media) for non-commercial purposes, provided you do not misrepresent its source or claim it as your own original work.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, title, and non-infringement;
• That the Service will be uninterrupted, timely, secure, error-free, or free of viruses or other harmful components;
• That AI-generated audit results will be accurate, complete, current, reliable, or suitable for your particular business situation;
• That any specific outcome, result, revenue, growth, or business improvement will result from acting on the audit feedback.

AI-generated feedback is inherently probabilistic, opinionated, and may be incorrect. The Service does not replace qualified business, legal, financial, or marketing advisors. We make no promise, representation, or guarantee — express or implied — that following the audit recommendations will improve your business in any measurable way. You assume full responsibility for evaluating and acting on any output.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BRUTALROAST, ITS OWNERS, EMPLOYEES, CONTRACTORS, AGENTS, OR AFFILIATES BE LIABLE — WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY — FOR ANY DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO:

• Indirect, incidental, special, consequential, exemplary, or punitive damages;
• Loss of profits, revenue, data, business, customers, opportunities, contracts, anticipated savings, or goodwill;
• Business interruption or loss of use of the Service;
• Damages arising from reliance on AI-generated audit feedback, whether or not such reliance was reasonable;
• Damages resulting from unauthorized access, data breaches, or security incidents affecting your account;
• Any action or inaction taken — or not taken — based on audit results, scores, or recommendations.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU ACTUALLY PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR USD $10, WHICHEVER IS LESSER.

The limitations above apply even if we have been advised of the possibility of such damages, and even if a remedy fails of its essential purpose. Some jurisdictions do not allow exclusion of certain warranties or limitation of liability, in which case our liability is limited to the maximum extent permitted by law in that jurisdiction.

11. Indemnification

You agree to indemnify, defend, and hold harmless BrutalRoast and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any applicable law or the rights of any third party.

12. Third-Party Services

The Service integrates with and depends on third-party services including Google Firebase, Dodo Payments, Anthropic, OpenAI, and Vercel. We are not responsible for the availability, accuracy, or practices of these third-party services. Your use of those services is governed by their respective terms and privacy policies.

13. Service Availability & Modifications

We reserve the right to:

• Modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice;
• Change pricing, features, or plan limits for new sign-ups at any time;
• Perform maintenance that may result in temporary unavailability of the Service.

We will make reasonable efforts to provide advance notice of material changes that affect existing paying customers.

14. Termination

We may suspend or permanently terminate your account, without notice or liability, if we believe you have violated these Terms, engaged in fraudulent activity, or if we discontinue the Service.

You may close your account at any time by contacting us at rajkateshiya.rk12@gmail.com. Upon termination, your right to use the Service ceases immediately. We may delete your data following the retention periods described in our Privacy Policy.

15. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If informal resolution fails, disputes shall be subject to the exclusive jurisdiction of the courts competent for the location of our principal place of business.

Nothing in this clause limits your statutory rights as a consumer under your local laws.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. If changes are material, we will notify you via email or a prominent notice on the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

17. Entire Agreement & Severability

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BrutalRoast regarding your use of the Service and supersede all prior agreements.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
